Appalachian Exam Coach — Nursing Coach Terms of Use
1. Parties, product and eligibility
These terms are between Appalachian Integrity LLC, a Virginia limited liability company (Company), and the adult individual who affirmatively accepts them (you). Appalachian Exam Coach is the study-app family name and Nursing Coach is the product name; neither is a separate legal entity. This agreement covers the Nursing Coach NCLEX-PN education product and its identified web and mobile interfaces. It does not cover inspection services or grant access to Weldbook AI or every future Appalachian Exam Coach product. You must be at least 18 and use your own account. Institutional, school and employer licences require a separate order.
2. Learning purpose and limits
Nursing Coach supplies original practice questions, explanations and progress tools for exam preparation. It does not provide diagnosis, treatment, clinical decision support, medical or nursing advice, a qualification, continuing-education credit or a nursing licence. Practice results measure performance on the questions presented; they do not predict an official exam result or certify readiness. There is no pass guarantee. Use current authoritative references and your education programme for instruction. Do not use a practice answer to make a patient-care decision. Contact a qualified professional for actual clinical questions and emergency services for an emergency.
3. Content status and exam affiliation
Nursing Coach is offered as an early release containing 800 original AI-assisted practice questions. Independent clinical review is pending; informal positive feedback on a sample is not documented item-level approval of the full bank. The questions and explanations may contain errors and are not independently validated exam preparation, an official exam simulator or a clinical reference. The free starter contains 32 of these questions. The purchase offer identifies the actual question count and formats available. Nursing Coach is independently developed and is not affiliated with, sponsored by or endorsed by NCSBN, Pearson VUE, a board of nursing or an exam provider. NCLEX, NCLEX-PN and NCLEX-RN are referenced to identify the exams; their marks belong to their respective owners. Questions are not represented as actual or recalled confidential exam items.
4. Access and permitted use
The free starter bank contains 32 early-release questions and requires no payment; ordinary access does not expire on a trial clock. A one-time paid upgrade unlocks the published Nursing Coach NCLEX-PN bank for your account. The accepted order defines the purchased product, total price and access scope. No recurring billing is authorized. Paid access has no scheduled expiry and continues while this product is operated, subject to these terms. It is not a promise of perpetual hosting, all future products or every future feature. A planned permanent shutdown or material removal of purchased functionality requires reasonable advance notice, ordinarily at least 90 days. If it prevents us from delivering the access described in your accepted order, we will offer a reasonable continued-access alternative or a refund or other remedy appropriate to the unfulfilled purchase, without limiting remedies required by law. Planned notice does not eliminate that obligation. Emergency security or legal restrictions may require earlier action. Any proposed change that reduces an accepted paid entitlement requires notice and affirmative agreement where required, or a remedy; silent posting does not alter the completed purchase.
5. Licence and intellectual property
Subject to your authorized access, you receive a personal, nonexclusive licence to use the app and its proprietary questions for your own study. Do not share passwords, resell access, extract or republish the proprietary bank, bypass access controls or distribute protected source material without permission. These restrictions do not override rights granted by a separately identified open-source or Creative Commons licence. Source attributions and licences remain with their material; open reference works are not claimed as exclusively owned by the Company. Your profile and study records remain your information. You permit the Company to process them only to provide, support and secure the service and comply with law, as described in the separate Privacy Notice. Voluntary suggestions about the product may be used to improve it without transferring ownership of confidential or third-party records. Do not submit restricted test items.
6. Accounts, conduct and safe use
Provide an email you control, keep credentials private and notify support of suspected unauthorized access. Do not submit patient names, records, photos, medical histories, identifiers or other real-person clinical information. Scenarios supplied by the app are educational simulations. Do not upload third-party question banks, exam recalls, malware or unlawful material. The app provides no facility for patient care. Read and answer screen-based cases only when safely parked or otherwise stationary. Set up any audio session before moving and stop when conditions require attention. Voice recognition can fail; do not handle the device or conduct distracting question-and-answer practice while driving. The app does not make device use legal or safe in a particular situation.
7. Voice and service operation
Speech features depend on your browser, operating system and selected voice. Microphone use is optional and requires permission. A browser or platform speech provider may process microphone audio under its own policy; on-device recognition is not promised. In the implemented browser and supported Android speech flows, the app server does not receive or retain microphone audio or raw recognized transcripts. The Privacy Notice explains the remaining processing. Screen formats, progress synchronization and network-dependent features require compatible software and connectivity. Maintenance, interruptions and errors can occur; no contractual uptime service level is offered. These limits do not cancel express purchase commitments or lawful remedies.
8. Purchase, support and account closure
The separate One-Time Purchase Disclosure and the order presented before payment identify the price, included product and payment processor. An app-store download alone does not prove purchase of the web upgrade. Invited testing access does not itself create a purchase; the public early-release offer is described separately. Contact john@appalachianintegrity.com for purchase problems, accessibility assistance or content errors, including the question identifier and a brief description without patient information. We respond to a paid-access or refund request within 14 calendar days, without extending any shorter response time required by law. Use the account export control to save your study records. Account deletion removes active profile and progress data and ends sign-in access; it does not automatically create a refund or erase legally necessary payment evidence. We provide a reasonable verification process to restore rightful purchase access to a replacement account when the purchase remains valid, using the processor receipt or other supported ownership evidence. Account deletion does not itself require repurchase. Do not treat uninstalling, signing out and deleting an account as the same action.
9. Suspension and discontinuation
We may restrict access reasonably necessary to address a material breach, security threat, unlawful activity or a legal requirement. When practicable, we give notice, explain the reason and allow correction or review. We do not promise to monitor every action. Restrictions do not authorize keeping money for a purchase we have failed to provide where law requires a remedy. You may stop using the app or request account deletion. Data handling follows the Privacy Notice and applicable law.
10. DISCLAIMER OF WARRANTIES
Except for express commitments in the accepted order and rights that law does not permit us to exclude, the app and practice content are provided as available. To the extent lawful, we disclaim implied warranties of merchantability, quality, accuracy and fitness for a particular purpose. Errors or interruptions may occur. This clause does not negate a legally actionable representation, responsibility for an undelivered purchase or nonwaivable rights and remedies. No warranty or liability limitation applies to separately contracted inspection services.
11. ECONOMIC LIABILITY LIMITS AND EXCEPTIONS
Only to the extent enforceable, the Company's aggregate liability for ordinary economic losses arising from this app agreement is limited to the greater of US$1,000 or the app fees you paid to the Company in the 12 months before the event giving rise to the claim. Only to the extent enforceable, indirect or consequential lost profits, business opportunity or anticipated savings are excluded. Direct losses are not relabelled as consequential merely because they concern study records, substitute services or an unsuccessful purchase. These limits do not apply to death or personal injury; fraud; gross negligence; willful or wanton misconduct; legally required refunds; nonwaivable privacy or consumer rights and remedies; or any liability the law prohibits limiting. A limit does not survive a judicial determination that it is invalid or legally fails of its essential purpose. These terms impose no contractual duty on you to indemnify or defend the Company.
12. Changes, disputes and notices
Material changes to these terms require advance notice, ordinarily at least 30 days, a stated prospective effective date and affirmative acceptance of the new version. No change retroactively governs an accrued claim or completed purchase. If you decline a material change, we preserve access to the originally purchased scope where practicable or provide the appropriate continued-access alternative, refund or lawful remedy if we cannot deliver it. A new-version gate must not be used to force surrender of an existing paid right without that process. Prior accepted versions remain available. Necessary protective restrictions are distinct from changing your contract. Virginia law governs to the extent legally applicable, without displacing another jurisdiction's mandatory consumer protections. Applicable law determines jurisdiction and venue; this agreement imposes no exclusive distant forum, mandatory arbitration, class-action waiver, jury waiver or shortened limitation period. A court may sever an invalid provision only to the extent lawful. Support and notices may be sent to Appalachian Integrity LLC, Craig County, Virginia, john@appalachianintegrity.com, (540) 524-2290. The Company uses your registered email for service notices and provides legally required delivery and retention methods; merely sending an unsuccessful email does not prove receipt. Separately displayed consent governs electronic transactions; this paragraph alone is not that consent.
